You give us permission to process the information you provide for the purpose of sending these communications and for analytics related to those messages. These terms explain how Good Chemistry collects and uses personal information when you opt in to receive our email communications, newsletters, or related messaging. Please read them carefully before subscribing.

Definitions
Personal data means information that identifies you, such as your name, email address, job title, organization, and any other data you provide when subscribing. Subscriber means a person who has given consent to receive email communications from Good Chemistry. Service provider means a third party that processes personal data on Good Chemistry’s behalf, for example an email platform or analytics provider.

By checking the box to subscribe and submitting your email address you provide explicit consent to receive commercial and informational email communications from Good Chemistry. Consent must be freely given and affirmative. The subscription box will not be pre-checked. We may also use a double opt-in process to confirm your address and consent. If we use double opt-in you must confirm your subscription via the confirmation link before you will receive marketing messages.

Every email will include a visible unsubscribe link. You may unsubscribe at any time without charge. If you request to unsubscribe by email we will process your request as quickly as possible and in no case later than ten business days. After you unsubscribe we may retain limited information necessary to prevent future mailings, to comply with legal obligations, and to keep records for security and fraud prevention.

Data retention and suppression lists
We retain subscriber data only as long as necessary to deliver email communications, comply with legal obligations, and maintain records for a reasonable time after you unsubscribe. We keep a suppression list to honor opt-outs and to prevent sending to unsubscribed addresses. That suppression list may contain limited identifiers and is retained for as long as necessary to comply with anti-spam obligations and to prevent re-sending to people who unsubscribed.

Rights under privacy laws
If you are subject to the General Data Protection Regulation, the California Consumer Privacy Act, or similar laws, you have certain rights which include the right to access, correct, delete, or receive a copy of the personal data we hold about you, and to withdraw consent at any time. For California residents the rights may include the right to know categories of personal information collected, the right to deletion, and the right to opt out of the sale of personal information. Good Chemistry does not sell email addresses for third party marketing.

Minors
You must be age 13 or older to subscribe. If you are under the legal age of consent in your jurisdiction you must obtain parental or guardian permission before subscribing. If we learn that we have collected personal data from a minor without appropriate consent we will delete it.

We take reasonable technical and organizational measures to protect personal data against unauthorized access and loss. No system is perfect and no security measure can guarantee absolute protection, so we cannot promise that data will be completely secure. If a security incident affects subscriber data we will follow applicable notification rules and will notify affected individuals as required by law.

Disclaimers and limitation of liability
Emails are provided for informational purposes only. To the maximum extent permitted by law, Good Chemistry disclaims all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. In no event will Good Chemistry be liable for indirect, incidental, special, punitive, or consequential damages arising from or related to email communications. Our total aggregate liability for claims related to our emails will not exceed one hundred dollars, or the amount you paid to Good Chemistry for services in the prior 12 months if greater.

We may update these terms from time to time. Material changes will be posted on our website and, where required by law, communicated to subscribers by email. Continued use of our email communications after changes indicates acceptance of the revised terms.

Governing law and disputes
These terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles. To the extent permitted by law, disputes will be resolved in the courts of the State of Georgia.
